Terms and Conditions
My Little Fairy is owned and operated by Nicole Cijs.In these terms and conditions the name My Little Fairy also counts for Nicole Cijs.
In General
These terms and conditions govern your use of My Little Fairy and its products or services. Please read through the Terms. If you do not agree with the Terms, then you do not agree with My Little Fairy’s terms of business. If you reach agreement by My Little Fairy or Nicole Cijs, your acceptance and payment indicates that you agree to be bound by the Terms. By accessing and browsing, purchasing services or products of My Little Fairy, you accept, without limitation or qualification, these Terms and Conditions. By agreeing our terms and conditions you promise to abide by them henceforth.The terms and conditions will only cease to be applicable when any such agreement is terminated by My Little Fairy or Nicole Cijs in writing. My Little Fairy shall undertake no work until the deposit has been received by Nicole Cijs and cleared confirmation is confirmed by a designated bank as determined by My Little Fairy. My Little Fairy prices do not cover the release of files.
I will design in accordance with the details agreed during the initial meeting between ourselves. It is important that you consider carefully your right to use materials such as images. You are responsible for obtaining all consents and permissions in relation to the use of all materials you supply to me. You shall also be responsible for complying with all relevant legislation and regulations in relation to the design and the content and the ongoing use of and access to the web site including but not limited to the data protection regulations. You shall be responsible for ensuring none of the materials you supply to me is defamatory, indecent or in breach of copyright and you will thus indemnify me against all and or any losses incurred by me in relation to the use of such materials or arising out of me providing the services to your specific requirements and or instructions.
The performance of my work is subject to you providing the material in the form of a photograph. You must agree to provide the material promptly and accurately and will nominate a contact for me to deal with, upon the commencement of your project.
Termination
Either party will be entitled to terminate the contract by written notice effective immediately if the other is in material breach.Terms of Payment
A deposit of 50% of the design costs will be required before any work is carried out. You will have a 7 day cooling time where you will be able to cancel the development and receive a full refund. After 7 days the deposit is non refundable.Prior to delivery of the printed artwork, I will require the remaining 50% of the total cost.
Failure to make the payment within this time will result in not receiving your design or a delayed receiving of your design until payment is received in full. A further charge of 30 euros per month or 2% per month (whichever is higher) of the outstanding payment will be charged until payment is received.
My Little Fairy will not be held responsible for any losses related to a delayed receiving of the design. Returned payments will result in the customer accruing an instant 30 euro fee added to the clients account balance. Customers agree that any payment failures will result in them taking on board expenses such as legal expenses including third parties sent to collect.
Design Completion
My Little Fairy will complete your design on or as close to the date specified at the beginning of the contract. Normally I will be able to complete your design before the contacted completion date. If there is no date specified I will complete your design, and notify you accordingly.Your Obligations
You are to provide the photo for your design, as soon as possible, to the start of the contract. Content will be supplied to me as specified on the page *How it Works* of the My Little Fairy website and in your design brief.You will ensure that I have all the correct information to place on your design, as this will ensure that your design will be completed sooner rather than later.
Failure to provide content and information to assist me to complete your design, may mean that your design can not be finished. You will have up to 14 days from the beginning of the contract to supply me with all the information I need to complete your design.
Copyright
Any use of any of the marks appearing throughout the Products and Services without the express written consent of My Little Fairy or the owner of the mark, as appropriate, is strictly prohibited. My Little Fairy owns the copyright of any designs created by My Little Fairy. Only with written permission can these be commercially reproduced or resold. I reserve the right to use the finished pieces for self promotion. Works are protected even if they are not registered at a Copyright Office and even if they do not carry the copyright symbol ©.Design Credit
A discrete signature of Nicole Cijs will appear at the bottom of each design.Liability
If My Little Fairy is liable, then this liability is restricted to that what is regulated in this provision. My Little Fairy can not be held liable for any damage (of whatever nature) that is a result of incorrect supplied data by their customer / client.The liability of My Little Fairy is always restricted to the full amount of the invoiced agreement value. If the agreement is carried out in phases the liability is restricted up to the relevant part or phase of the agreement.
My Little Fairy is never responsible for indirect damage, included consequence damage, lacked profit, missed savings or damage by company stagnation.
